NEW YORK (AP) -- RETAIL RUMBLE: J.C. Penney Co. and Macy's Inc. are duking it out in New York State Supreme Court over the right to sell Martha Stewart merchandise.
MARTHA, MARTHA, MARTHA: Macy's believes an agreement gives it the exclusive right to sell Martha Stewart-branded products in certain categories such as cookware, bedding, and bath. Exempted are sales at Martha Stewart stores. In 2011, J.C. Penney announced a partnership in which it would open Martha Stewart mini shops in most of its stores this spring. They argue that while the shops will be located in its stores, they are still Martha Stewart stores.
EXECUTIVES ON THE STAND: Stewart, J.C. Penney CEO Ron Johnson and Macy's CEO Terry J. Lundgren may be called to testify during the trial, which could last three weeks. Supreme State Court Judge Jeffrey Oing will be deciding the outcome of the trial, rather than a jury.
