Victoria's Secret Is Suing For The Right To Use The Word 'Naked'

Victoria's Secret wants a federal judge to decide whether it can use the word "naked" in a cosmetics line. 

The lingerie mega-chain is sparring with Urban Decay cosmetics over use of the word, reports Rick Rouan at Columbus Business First.

Victoria's Secret asked a judge in Columbus, Ohio, where the company is based, to decide whether they could continue to use the word.

Rouan also provided some background on the conflict: 

Victoria’s Secret, the lingerie arm of Columbus’ Limited Brands Inc.(LTD), said in the lawsuit that it has used that term for cosmetics since June but began using it for lingerie more than two years ago. The lawsuit says the company owns a trademark for “The Nakeds By Victoria’s Secret,” which can be used for its bras and panties.

Urban Decay sent a cease and desist letter on July 18 and threatened further legal action if it did not receive a response by July 27, according to the lawsuit filed July 31.

Here are the company's bras that use the term. They use the same term for make up, which is what Urban Decay is taking issue with.

Neither company has commented publicly about the case.
