The lawsuit at issue was filed in the Westchester County Supreme Court on behalf of an infant client who was named as the plaintiff and against the named defendant, an obstetrician. The case was assigned a case number of 89042A and it sought damages that would compensate the plaintiff for the permanent injuries suffered during the situation that gave rise to this controversy.
According to the court documents, the plaintiff's mother began experiencing labor pains and was urinating frequently when she had reached 26 weeks of gestation. She contacted the defendant doctor who admitted her to a nearby hospital. The mother was placed on a medication that was designed to delay labor and she was then transferred to a different hospital that was more equipped to care for a woman who could give birth to a premature child.
The court documents went on to state that at the second hospital, the mother was still experiencing contractions along with frequent and urgent urination. At that point, a urinalysis was ordered along with a urine culture by a different doctor. The urinalysis showed occasional bacteria and the culture showed no growth. No antibiotic medications were administered for this possible infection.
The court documents described the situation where seven hours after these tests were done, the plaintiff's mother was diagnosed with a urinary tract infection and antibiotic medication was ordered. The next morning, the contractions returned and the plaintiff was born that afternoon. His birth weight was 2 pounds, 2 ounces. He was eventually diagnosed with cerebral palsy, hydrocephalus and mental retardation.
