Brian: Though this lawsuit is going no where, I wonder what the courts would do if the Senate just stopped confirming any Supreme Court justice, so that it dwindled to zero (this could happen in 10 years based on their ages). Clearly we are meant to have a separate but equal supreme judiciary, but the Constitution, does not require the Senate to act. Maybe, some day in the future, we amend to require a vote within 6 months of nomination (Senate is free to vote no or yes and could do so for multiple nominations).
