The lawsuit filed against Team Industrial Services, Inc., alleges the company failed and continues to fail to accurately calculate and pay their California non-exempt employees for overtime worked. Allegedly, Team Industrial Services, Inc., unlawfully and unilaterally fails to accurately calculate wages for overtime worked by their employees in order to avoid paying them the correct overtime compensation. State law provides that employees must be paid overtime at one-and-one-half times their "regular rate of pay."
Additionally, the lawsuit alleges PLAINTIFF and other CALIFORNIA CLASS Members were also from time to time unable to take off duty meal breaks and were not fully relieved of duty for meal periods due to their rigorous work schedules. PLAINTIFF and other CALIFORNIA CLASS Members were required to perform work as ordered by DEFENDANT for more than five (5) hours during a shift without receiving an off-duty meal break.
