ALAMEDA, Calif., Oct. 7, 2020 /PRNewswire-PRWeb/ -- The San Francisco employment law attorneys at Blumenthal Nordrehaug Bhowmik De Blouw LLP, filed a class action complaint alleging that Decathlon USA LLC failed to provide their California employees with proper compensation. The Decathlon USA LLC class action lawsuit, Case No. RG20073024, is currently pending in the Alameda Superior Court of the State of California. A copy of the Complaint can be read here.

According to the lawsuit filed, Decathlon USA LLC allegedly (a) failed to pay minimum wages, (b) failed to pay overtime wages, (c) failed to properly record and provide legally required meal and rest periods, (d) failed to provide accurate itemized wage statements, (e) failed to reimburse employees for required expenses, (f) failed to provide wages when due, and (g) failed to provide personnel files, all in violation of the applicable Labor Code sections listed in Labor Code Sections §§ 201, 202, 203, 226, 226.7, 510, 512, 1194, 1197, 1197.1, 1198.5, 2802, and the applicable Wage Order(s), and thereby gives rise to civil penalties as a result of such alleged conduct.

Additionally, the complaint further alleges Decathlon USA LLC committed acts of unfair competition in violation of the California Unfair Competition Law, Cal. Bus. & Prof. Code §§ 17200, et seq. (the "UCL"), by engaging in a company-wide policy and procedure which failed to accurately calculate and record all missed meal and rest periods by PLAINTIFF and other CALIFORNIA CLASS Members. As a result of DEFENDANT's intentional disregard of the obligation to meet this burden, DEFENDANT allegedly failed to properly calculate and/or pay all required compensation for work performed by the members of the CALIFORNIA CLASS and violated the California Labor Code.
