The plaintiff was allegedly injured while on the premises of the defendant and she seeks damages to recapture her losses.
According to the court documents, the plaintiff was allegedly a lawful entrant onto the property of the defendant for the purpose of conducting business there. While she was there, the ceiling at the property allegedly collapsed and this incident caused the plaintiff to slip and fall because of the surprise and the debris that was landing near her. As a result of this incident, the plaintiff claims to have suffered several serious injuries to her neck and to her back that required and that continue to require extensive medical attention and treatment.
The attorneys at Bernstein & Maryanoff filed the lawsuit against the defendant alleging that: (1) there was a dangerous condition present on the premises; (2) the defendant either knew or should have known about this dangerous condition; (3) the defendant failed to either remove this dangerous condition or to clearly warn foreseeable entrants onto the property that such a dangerous condition existed; and (5) that this dangerous condition caused the injuries suffered by the plaintiff.
The plaintiff is seeking several different forms of damages as part of this lawsuit. Examples of the types of losses the plaintiff both has and will incur include those that relate to medical expenses, a loss in the enjoyment of life, pain and suffering and several other forms of damages that will be laid out and determined at trial.
