Schlesinger Law Firm Wins $3.5 million Jury Verdict in Hip Implant Case

FORT LAUDERDALE, FL / ACCESSWIRE / November 23, 2020 / Schlesinger Law Offices has won a $3.5 million jury verdict for a Fort Dodge, Iowa woman who suffered complications from a metal-on-metal hip implant surgery.

In 2007, Plaintiff Lori Nicholson received a hip implant manufactured by Biomet Inc. She had a revision in 2012 after the hip loosened due to metal ion disease. Ms. Nicholson developed pain, a pseudo cyst and elevated levels of chromium in her blood. Biomet's metal-on-metal hips are no longer sold in the United States.

Despite rising COVID cases in Iowa, attorneys Bryan Hofeld and Jeffrey Haberman of Schlesinger Law Offices volunteered to travel to Cedar Rapids for the two-week trial in federal court. The case was tried before United States District Court Judge C.J. Williams in the Northern District of Iowa.

COVID precautions, including masks and social distancing, were fully enforced by Judge Williams for all members of the jury, respective trial teams and court staff. Eight jurors were originally selected for the trial. However, two were dismissed during trial for COVID-related reasons, leaving six jurors who ultimately deliberated for just under four hours in reaching their verdict.

Days before this trial was scheduled to begin, a mistrial was declared in another case that was tried in the same courthouse because a juror and an attorney got COVID. Understanding the same could have happened here, the Schlesinger attorneys pressed ahead for their client.

Of the total award of $3.5 million, $1 million ($1,050,000.00) was for compensatory damages and $2.5 million was for punitive damages.
