The case alleges that Vroom and its senior executives made misleading statements to investors and failed to disclose that: (1) Vroom had not demonstrated that it was able to control and scale growth in respect to its salesforce to meet the demand for its products; (2) as a result, Vroom was forced to discount aged inventory to move through its retail channels or liquidated in its wholesale channels; and (3) as a result, the ecommerce gross profit per unit was reasonably likely to decline.

Interested Vroom investors have until May 21, 2021 to retain counsel and apply to be a lead plaintiff if they are interested to do so. Investors do not need to be a lead plaintiff in order to be a class member. A lead plaintiff acts on behalf of all other investor class members in managing the class action.
