NEW YORK, NY--(Marketwired - April 04, 2013) - The New York medical malpractice attorneys at Fitzgerald & Fitzgerald began representing clients who were injured as a result of substandard medical care in 1971. The lawsuit at issue was filed in the Kings County Supreme Court and it was assigned a case number of A01124. The case was filed on behalf of infant twin brothers who were born at the defendant hospital, which was New York Methodist Hospital in Brooklyn. The reason that the case was filed was because the attorneys at Fitzgerald & Fitzgerald alleged that the defendant failed to deliver the twins in a timely manner and that because of this alleged negligence the plaintiffs suffered serious injuries.
According to the court documents, the mother of the twins reported to the defendant hospital at 29 weeks of gestation because she had suffered a premature rupture of uterine membranes. She had previously been classified as a 'high-risk' pregnancy because of a history of obesity, hypertension, atherosclerotic heart disease, and a myocardial infarction. The plan for the birth was to perform a C-section when it was time to deliver the infants.
She was admitted to the hospital because she was complaining of chest pains and her contractions began at that time. The court documents alleged that at that point, the mother was not brought in for a C-section but was instead allowed to wait for a period of two days while amniotic fluid continued to leak. After making the decision to commence with the C-section after those two days, the twin boys were born on the way to the delivery room vaginally.
The court documents described Twin A as severely physically depressed and as suffering from severe respiratory difficulty. Twin B was described in the documents as moderately physically depressed and he too suffered from respiratory deficits. Twin A was ultimately diagnosed with cerebral palsy and Twin B was diagnosed with motor deficits and learning disabilities.
The attorneys at Fitzgerald & Fitzgerald argued in the court documents that the defendant hospital failed to (a) act in a timely manner to delay the infant Plaintiffs' premature birth, (b) diagnose and treat fetal distress, and (c) perform a timely and proper delivery during the labor. The case ultimately settled for an amount of $8 million.
