Regarding the 1977 Pipelines Treaty between Canada and the USA, which Canada invoked in its brief to the court:
We have a network of more than 70 pipelines and 30 electricity transmission lines that go cross-border. Of those, 21 pipelines flow from the United States to Canada, which makes Canada the largest market for U.S. exports of crude.
Let’s, for a minute, imagine if any province or state could simply start unilaterally cancelling these lines, citing “public trust” reasons. This may have been Canada’s not-so-subtle way of saying, “two can play at that game, but we don’t really want to.”
With the international treaty implications, the interstate implications and the potential precedent that would be set for every cross-border piece of energy infrastructure, it seems unlikely that the court would decide this matter as a purely state affair and that Whitmer had the sole authority to shut it down.

So what is her basis for ordering this shutdown????
Yes, its about $$$. She wants fees/royalties. Where I come from, we call it extortion.
Two can play at that game.

So, in addition to having the Pipelines Treaty on our side, I read somewhere that the easement agreement that Gretch wants to terminate is clear: If the governor really wants to terminate the easement, she has to send them a letter officially notifying them specifically how they are in breach of the easement agreement, and then give them a reasonable time to correct the violation. Then, if Enbridge fails to correct the problem, the easement can be terminated. All the jumping up and down in the world saying the line is unsafe and should be shut down doesn't terminate the agreement until that happens.

Ms. Whitmer’s bid to shut down Line 5 was an election promise she made in the 2018 gubernatorial race, and her concern is focused on the point where it crosses the Straits, a major waterway in northern Michigan. Her order revokes an easement permit for the crossing first granted in 1953.

The pipeline has never leaked oil in the Straits since it began operating in 1953. But in 2010, another pipeline operated by Enbridge, Line 6B, ruptured and released petroleum into a tributary of the Kalamazoo River, becoming one of the largest inland oil spills in U.S. history.

Michigan Senate Republicans adopted a budget amendment Wednesday requiring the Department of Natural Resources to reimburse Enbridge's legal fees if the state loses its challenge to the Canadian company's easement for Line 5 through the Straits of Mackinac.

It blows my mind how some politicians (and the people who elect them) would believe that removing the supply would somehow remove the demand. Close line 5, how are you gonna get 540,000 barrels to Sarnia every day? By truck and train? Is that really a more environmentally conscious decision?

Canada must stand up to the US. If the Enbridge Line 5 is shut down, there must be repercussions at all levels. We have endured the last 4 years of the prior administration and to say the least there is no love lost there. The US has treated Canada Badly!!!! And it continues to do so!!
