    LabCorp backs lawsuit challenging Medicare reimbursement rates

    In a lawsuit filed in federal court on Monday, the American Clinical Laboratory Association (ACLA) said the U.S. Centers for Medicare and Medicaid Services (CMS) “ignored Congressional intent” by putting in place the new system after the Protecting Access to Medicare Act was passed. “ACLA, LabCorp, and others in the laboratory industry have continued to address the serious deficiencies in the way that CMS has implemented PAMA,” said David King, chairman and chief executive officer of LabCorp in a statement.

    Medical lab trade group sues over U.S. reimbursement cuts

    A U.S. trade association representing medical laboratories filed a lawsuit on Monday challenging a new reimbursement system used by the federal government that it said would reduce how much Medicare pays for labs by about $670 million in 2018. The American Clinical Laboratory Association (ACLA) in a lawsuit in federal court in Washington, D.C., said the U.S. Centers for Medicare & Medicaid Services (CMS) ignored Congressional intent by implementing the new system following the passage of a 2014 law.

    Reimbursement cuts on lab tests pressure US lab firm shares

    A federal agency on Friday rolled out deep cuts to reimbursement rates for some lab tests under Medicare, a move that could save the government as much as $3 billion over five years, but hurt margins of U.S. laboratory companies. The cuts, which are expected to save about $670 million in Medicare payments in 2018, were roughly in line with a preliminary proposal published by the Centers for Medicare and Medicaid Services (CMS) in September. About three quarters of the more than 1,300 lab tests surveyed by the agency will be affected by the cuts, Canaccord Genuity analyst Mark Massaro said.

    A securities filing made Tuesday by Express Scripts Holdings (ESRX) disclosed two large lawsuits that claim its subsidiary United Biosource helped drugmakers market their products in violation of antitrust and anti-kickback laws. The allegations in those suits touch on issues that Barron’s covered in a 2015 story that described how UBC’s contracts to promote drugmakers’ high-priced products seemed to conflict with the mission of its pharmacy benefit management parent: that is, to keep a lid on America’s drug bills (“Express Scripts Unit’s Connection to High Priced Specialty Drugs,” November 21, 2015). Other companies also named as defendants in the two suits were Eli Lilly & Co. (LLY) and Mallinckrodt PLC (MNK), as well as the Covance unit of Laboratory Corp. of America Holdings (LH).
